PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE CONDUCTING BUSINESS WITH US. IT IS ADVISABLE TO PRINT AND RETAIN A COPY OF THESE TERMS AND CONDITIONS ALONG WITH ANY ORDERS FOR FUTURE REFERENCE.
Terms & Conditions of Sale
Jemima Jasmine may change these Terms & Conditions without prior notice.
1.Terms of the Contract
These Terms & Conditions apply to all goods supplied by Jemima Jasmine they do not affect your statutory rights.
Any order placed by you for goods advertised on our website is considered an offer by you to purchase the goods in your order. No contract exists between you and us until we have received and accepted your order. Each time you place an order, you will receive an automated email confirming this. The notification of receipt is not a confirmation that the order has been accepted.
The contract is subject to your right of cancellation (see condition 6 below).
We reserve the right to terminate the contract of sale if the payment for ordered goods is not received in full.
2.Description and Price of Goods
All of our products are hand made and subject to slight variations in design and/or colour to the images shown on our website and/or social media channels. We have taken every care to describe and show all items as accurately as possible. We offer a sample service which is a great way to confirm design/colours prior to placing your purchase. The cost of a 50cm x 50cm sample is £60 (hand-tufted) – £150 (hand-knotted) which is fully refundable when you return the sample to us. If there is anything you wish to clarify prior to placing your order please contact us using the details on our Contact Us page.
Prices are supplied on the website in GBP. If applicable, VAT is included in the price at the standard rate as laid out by the British Government http://www.hmrc.gov.uk/vat/.
If the goods are to be shipped to an address outside the EU, you will be liable to pay the appropriate duty on the goods as decided by the destination country. JemimaJasmine LTD is not liable for these duties.
Please note: for all U.K. orders there is a duty charge of 8% and a VAT charge of 20%. This will show up in your shopping cart as a combined charge.
Online payment may be made by Direct Transfer (BACS), Debit/Credit card, Paypal or Stripe
If your payment fails, your order will be cancelled within 14 days, unless you contact us to specify otherwise.
No goods will be dispatched until payment has been made in full and funds have cleared.
Shipping and Handling charges are applied per item and included in the order total shown at checkout.

We do not store credit card details nor do we share customer details with any 3rd parties.
We currently deliver to the U.K, Belgium, France, Germany, Italy, Spain and Switzerland.
If you require shipping to another country please contact us directly with your requirements and we will organise that for you.
We will provide a dispatch date for the item shortly after confirmation of your order. We use Fedex and Tnt for delivery and Ace Fright for rugs over the size 3m x 3m.
Delivery will be made to the Delivery Address specified at checkout when you complete your order or separately agreed by email. Should you wish to change the delivery address after goods have been dispatched from our warehouse, we will require you to cover the redirection charges. Please be aware that the redirection approval is subject to your order and account status.
Jemima Jasmine retains ownership of all items until they have been paid for in full and delivered to the destination address. Once your goods have been delivered, the risk of damage or loss of the item passes to the recipient.
Jemima Jasmine does not offer a return policy, unless the rug is damaged on arrival.
6.Item(s) Damaged on Arrival
In the unlikely event that you receive a damaged product, you should notify us in writing (using the details on our Contact Us page) within 48 hours of receipt of the goods. Please provide photographic evidence of the damage. We will arrange a courier collection of the damaged item. Once we receive the item at our warehouse, we will examine the goods for damage as per the photographic evidence. If the damage is verified, we will replace the item within 6 weeks at no additional cost to you.
If you are eligible for a refund, we will refund you via the method of payment you used when you originally paid for your order. The refund amount will be the total amount you have paid for the particular order or a fraction of this, depending on the nature of the fault at hand. Please note: it is your responsibility to advise us of any changes to your payment method.
8.Limitation of Liability
Jemima Jasmine will not be liable to you for any loss or damage in circumstances where:
1.There is no breach of a legal duty owed to you by Jemima Jasmine or by its employees or agents;
2. Such loss or damage is not a reasonably foreseeable result of any such breach;
3. Any increase in loss or damage resulting from breach by you of any item of this contract
Jemima Jasmine will take all reasonable precautions to keep the details of your order and payment secure. However, unless Jemima Jasmine are negligent, we will not be liable for unauthorised access to information supplied by you. Jemima Jasmine will not supply your details to any third party.
We take every care to ensure that the description and specification of our products are precise. However, specifications and descriptions of products on this website are not intended to be binding and are intended only to give a general description of the products. Furthermore, while the colour reproduction of the products is a close representation, we cannot accept any responsibility for any variation in colour caused by the browser software or computer system used to view the products.
A Yarn Card is the best way to see an indication of the colours of your chosen design. Each card has a small swatch of wool attached to it, which the rug will be matched to. Viewing the yarn strands from the side of this yarn card (i.e. looking into the ends of the strands) helps simulate cut pile wool. Viewing the yarn strands from the front of the yarn card (i.e. looking at the length of the yarn strands) helps simulate silk. Due to the handcrafted nature of our products, the actual colour and surface texture may differ slightly from this yarn card. As with all raw materials and natural fibres, minor differences are inevitable. These should not be interpreted as defects but are a reflection of the handcrafted nature of the product.
We own, control and operate the web site from our offices within England. Accordingly the laws of England & Wales govern claims relating to, including the use of the web site and the materials contained therein. If you choose to access our website from outside England and Wales you do so on your own initiative and you hereby agree that in the event of a dispute between JemimaJasmine Ltd and you the laws of England and Wales will apply at all times.
13.Protecting Your Security
All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.
14.Placing an Order
By placing an order with JemimaJasmine LTD you are confirming you have read and agreed to the terms, conditions and delivery times as laid out in writing on this site. The contract of the sale is bound by the terms laid out in this document.
The contract laid out in this document is between Jemima Jasmine and yourself, the customer. In the event of goods shipped to an addressee other than yourself (the customer), we have no contract between ourselves and the end receiver of the goods shipped (your customer). In this case we cannot mediate any aspect of the sale between yourself (the customer) and the end receiver of the goods shipped (your customer).
15.Misuse of Goods
We make every reasonable effort to ensure that the information on this website is accurate and up-to-date. The material here is intended to provide general information and users are advised to seek further legal guidance before acting or relying on the contents. We disclaim all liability for loss and/or damage that may result from the use of information contained on this site.
Jemima Jasmine will not be held responsible for any death or personal injuries that occur from the misuse of goods advertised on this website.
